Important: By creating an account or using Telemiq, you agree to these Terms of Service. Please read them carefully before using the platform.
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Telemiq ("Company", "we", "us", or "our"), governing your use of the Telemiq platform, website, mobile application, and all related services (collectively, the "Service").
By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must not use the Service.
These Terms are supplementary to and incorporate by reference our Privacy Policy, which governs the collection and handling of your personal information.
To use Telemiq, you must meet all of the following eligibility requirements:
We reserve the right to verify your eligibility at any time and to suspend or terminate accounts that do not meet these requirements.
To use the Service, you must register for a Telemiq account. During registration, you agree to:
You may not create more than one Telemiq account. Duplicate accounts will be identified and may be consolidated or terminated at our discretion.
Telemiq integrates with your Tesla vehicle through the official Tesla Fleet API using OAuth 2.0 with Proof Key for Code Exchange (PKCE) authentication. By connecting your Tesla account, you acknowledge and agree to the following:
Upon your authorization, Telemiq will access the following data from your Tesla account:
Your Tesla connection uses industry-standard OAuth 2.0 PKCE, which means your Tesla login credentials are never shared with or stored by Telemiq. You authenticate directly with Tesla, and we receive only a limited-access authorization token.
All Tesla API tokens are encrypted at rest using AES-256-GCM encryption before storage. Tokens are decrypted only when needed to retrieve charging data and are never shared with third parties.
You may revoke Telemiq's access to your Tesla data at any time through your Tesla account settings (Account Settings → Security → Third Party Apps → Manage). Upon revocation, all stored tokens are permanently deleted and all telemetry streams are terminated.
In addition to the OAuth Fleet API connection described above, Telemiq uses Tesla Fleet Telemetry to receive real-time, vehicle-pushed charging data directly from your Tesla. This requires pairing a virtual key (also called a digital key) to each of your vehicles.
Purpose: The virtual key authorizes your Tesla vehicle to push telemetry data streams to our server. This enables:

Important: The virtual key does NOT grant vehicle control. Telemiq cannot unlock your doors, start the vehicle, activate climate control, honk the horn, or issue any commands to your Tesla. The key is strictly read-only — it only allows your vehicle to send data to our server. You can revoke the virtual key at any time through your Tesla app (Manage > Locks > remove the Telemiq key) or via Tesla Account > Security.
Telemiq requests the following Tesla Fleet API scopes. All are read-only except where noted:
Telemiq automatically detects and tracks your charging sessions through the Tesla Fleet API. To qualify for rewards, sessions must meet our home charging verification criteria.
You are required to set a "Home Location" within your Telemiq account via Settings > Home Location. Charging sessions are verified as home charging using GPS coordinate matching within a 500m geofence radius. The geofence uses the Haversine formula to calculate the distance between your charging location and your registered home address.
Each charging session undergoes automated verification including location matching, energy delivery validation, timestamp analysis, and anomaly detection. Sessions that fail verification will not qualify for rewards.
Purpose of Data Collection: Telemiq collects vehicle location data, energy consumption metrics, and charging session timestamps through Tesla's official Fleet Telemetry API for the sole purpose of Measurement, Reporting, and Verification (MRV). This enables the generation of credible, audit-ready carbon credits under Environment and Climate Change Canada's Clean Fuel Regulations (CFR) and Ontario-supported climate programs. These credits represent verified, real-world greenhouse gas emission reductions achieved by charging your electric vehicle with electricity instead of gasoline or diesel fuel.
Scope of Location Data: Vehicle GPS coordinates are collected at a maximum frequency of once every 15 minutes only while the vehicle is awake and connected. When the vehicle enters sleep mode (typically within 10–15 minutes of parking and locking), no location data is transmitted. Telemiq does not conduct continuous, real-time, or second-by-second GPS tracking. Location data is collected exclusively to verify that charging occurs within the approved home geofence radius (500 metres of your registered home address), as required by CFR compliance protocols.
Non-Charging GPS Destruction: When GPS data is received and the vehicle is not actively charging, the location data is immediately and permanently destroyed — it is never written to the database, never stored in server memory, and never logged. Telemiq does not build a location history, does not track driving routes, and does not know where your vehicle travels. The only GPS data retained is the coordinate recorded during an active charging session, serving as audit proof for carbon credit verification. See our Privacy Policy Section 2.8 for full technical details on the three-layer GPS privacy protection system (Drop, Gate, Purge).
CFR Compliance & Audit Trail: All collected data — including GPS coordinates, energy delivered (kWh), charging timestamps, and geofence verification results — is stored in an immutable audit trail retained for a minimum of seven (7) years, as required by Environment and Climate Change Canada. This data may be disclosed to regulatory authorities, third-party auditors, or carbon credit aggregators for the purpose of verifying emission reductions and issuing carbon credits. By participating in the Telemiq program, you consent to this data being used for compliance reporting and carbon credit generation.
Data Minimization: Telemiq adheres to a strict data minimization principle. We collect only the vehicle data fields necessary for MRV compliance and reward calculation. We do not collect driving behaviour data, speed, acceleration, cabin camera footage, Autopilot data, or any data unrelated to charging verification and environmental compliance. Telemetry data collection is limited to: charge state, battery level, energy delivered, charging power, vehicle location (during charging), DC fast charging detection, and odometer reading.
Reward Eligibility Contingent on Data Access: Earning Telemiq rewards requires the collection of verifiable charging data including GPS location. If you revoke GPS/location access, disable telemetry, or remove the virtual key, Telemiq cannot verify home charging and no rewards will be credited until access is restored. This is a technical and regulatory requirement — carbon credits cannot be issued without verifiable location data proving that charging occurred at the participant's registered home address.
Telemiq rewards verified home charging at tiered rates based on data connection mode:
Telemetry Mode (Fleet Telemetry): 5 points per verified kWh of home charging energy delivered. Required for members without an enrolled Wall Connector.
Standard Mode (Fleet API Polling): 5 points per verified kWh of home charging energy delivered (flat rate, effective 2026-09-17). Available only to Wall Connector-enrolled members.
Rewards are calculated on a per-session basis and accrued as integer points to your Telemiq balance. Each charging session generates a specific point amount calculated by multiplying the verified kWh by the applicable rate (flat 5 pts/kWh for both Telemetry and Standard modes, effective 2026-09-17). All point values are stored as integers to prevent rounding errors.
The reward rate may be adjusted from time to time based on carbon credit market conditions, program costs, and regulatory changes. Any rate changes will be communicated with 30 days' advance notice as specified in Section 19.0.
To qualify for rewards, charging sessions must meet all of the following criteria:
Public Supercharger sessions, destination charging, and sessions at commercial locations do not qualify for rewards.
Telemiq employs automated anomaly detection systems to maintain the integrity of the rewards program. Our systems analyze charging patterns, energy delivery rates, location data, and behavioral signals to identify irregularities.

Telemiq operates a referral program that allows existing users to earn bonuses by inviting new users to the platform.
When a referred user (the "Referee") creates a Telemiq account, connects their Tesla, and accumulates 2,500 kWh of verified home charging (10,000 points / C$100.00), both the referrer and the Referee will each receive a $5.00 CAD referral bonus credited to their respective Telemiq balances.
To protect the integrity of the referral program:
We reserve the right to modify or discontinue the referral program at any time, subject to the notice requirements in Section 19.0.
You may withdraw your accumulated Telemiq balance via Interac e-Transfer to your registered Canadian bank account, subject to the following conditions:
Withdrawals are subject to review and may be delayed if suspicious activity is detected.
Rewards earned through Telemiq may constitute taxable income under Canadian tax law. You are solely responsible for:
Tax Notice: Telemiq does not provide tax advice. We may issue T4A slips for qualifying users as required by the Canada Revenue Agency (CRA). The Organization is not responsible for your individual tax compliance.
Telemiq aggregates verified home charging data to generate carbon credits under Canada's Clean Fuel Regulations (CFR). By using the Service, you acknowledge and agree to the following:
Your privacy is of utmost importance to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
By using the Service, you consent to the collection and use of your information as described in our Privacy Policy. We are committed to compliance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation.
All intellectual property rights in the Telemiq platform, including but not limited to software, designs, logos, trademarks, trade names, and documentation, are owned by or licensed to Telemiq
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms. You may not reproduce, distribute, modify, create derivative works of, or exploit any content or functionality of the Service without our express written permission.
To the maximum extent permitted by applicable law:
You agree to indemnify, defend, and hold harmless Telemiq, its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:
You may terminate your account at any time by contacting us or using the account deletion feature within the app. Upon termination, any pending rewards below the minimum withdrawal threshold will be forfeited.
We may suspend or terminate your account immediately, without prior notice, for:
Upon termination, your right to use the Service ceases immediately. We will delete your Tesla API tokens and personal data in accordance with our Privacy Policy and data retention schedule. Provisions that by their nature should survive termination shall remain in effect, including Sections 11, 12, 14, 15, 16, and 18.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada.
Before initiating formal proceedings, you agree to first attempt to resolve any dispute by contacting us at info@telemiq.io. We will attempt to resolve the dispute through good-faith negotiation within 30 days.
If the dispute cannot be resolved informally, you agree that any claim shall be resolved exclusively through binding arbitration administered in accordance with the Arbitration Act (Ontario). The arbitration shall be conducted in Toronto, Ontario, and may be conducted remotely at the arbitrator's discretion.
You agree that any arbitration or legal proceedings shall be conducted on an individual basis only, and not as a class action, collective action, or representative action.
We reserve the right to modify these Terms at any time. When we make material changes, we will:
Continued use of the Service after the effective date of any modifications constitutes your acceptance of the revised Terms. If you disagree with any changes, you must stop using the Service and terminate your account.
