Terms of Service

Telemiq Solutions Inc.

Last Updated: June 22, 2026

Important: By creating an account or using Telemiq, you agree to these Terms of Service. Please read them carefully before using the platform.

1.0 Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Telemiq Solutions Inc. ("Company", "we", "us", or "our"), governing your use of the Telemiq platform, website, mobile application, and all related services (collectively, the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must not use the Service.

These Terms are supplementary to and incorporate by reference our Privacy Policy, which governs the collection and handling of your personal information.

2.0 Eligibility

To use Telemiq, you must meet all of the following eligibility requirements:

  • Age: You must be at least 18 years of age or the age of majority in your province of residence.
  • Tesla Ownership: You must be the registered owner or lessee of a Tesla vehicle with an active Tesla account.
  • Canadian Residency: You must be a resident of Canada with a valid Canadian bank account capable of receiving Interac e-Transfers.
  • Legal Capacity: You must have the legal capacity to enter into binding contracts under applicable Canadian law.

We reserve the right to verify your eligibility at any time and to suspend or terminate accounts that do not meet these requirements.

3.0 Account Registration

To use the Service, you must register for a Telemiq account. During registration, you agree to:

  • Provide accurate, current, and complete information about yourself as prompted by the registration form.
  • Maintain and promptly update your account information to keep it accurate, current, and complete.
  • Maintain the security of your password and accept all risks of unauthorized access to any account or data.
  • Notify Telemiq immediately of any unauthorized use of your account or any other breach of security known to you.

4.0 Tesla Integration

Telemiq integrates with your Tesla vehicle through the official Tesla Fleet API using OAuth 2.0 with Proof Key for Code Exchange (PKCE) authentication. By connecting your Tesla account, you acknowledge and agree to the following:

  • Data Access: Upon your authorization, Telemiq will access the following data from your Tesla account: vehicle identification, charging session data (start/end times, energy delivered, location), vehicle state, and odometer readings.
  • Security: Your Tesla connection uses industry-standard OAuth 2.0 PKCE, which means your Tesla login credentials are never shared with or stored by Telemiq. You authenticate directly with Tesla, and we receive only a limited-access authorization token.
  • Token Storage: All Tesla API tokens are encrypted at rest using AES-256-GCM encryption before storage. Tokens are decrypted only when needed to retrieve charging data and are never shared with third parties.
  • Revocation: You may revoke Telemiq's access to your Tesla data at any time through your Tesla account settings (Account Settings → Security → Third Party Apps → Manage). Upon revocation, all stored tokens are permanently deleted and all telemetry streams are terminated.
  • Fleet Telemetry: In addition to the OAuth Fleet API connection described above, Telemiq uses Tesla Fleet Telemetry to receive real-time, vehicle-pushed charging data directly from your Tesla. This requires pairing a virtual key (also called a digital key) to each of your vehicles.

5.0 Rewards Program

Telemiq offers a rewards program that pays members for verified home charging. The program operates as follows:

  • Earning Rate: Members earn a flat 5 points per kWh of verified home charging. Every 100 points equals C$1.00 in reward value. Telemetry (virtual key) enrollment is required for setups without an enrolled Tesla Wall Connector.
  • Geofence Verification: Only charging sessions that occur within your registered home geofence qualify for rewards. GPS geofence verification is automatic — no manual check-ins are required.
  • Public Charging Exclusion: Sessions at Superchargers, destination chargers, or any location outside your home geofence do not qualify for rewards.
  • Payouts: Rewards are paid via Interac e-Transfer after the annual Q1 carbon credit audit (January–March). Verified points become redeemable once the audit is complete. Minimum withdrawal is 10,000 points (C$100).
  • Anti-Fraud: Any attempt to game the system — including but not limited to GPS spoofing, using non-Tesla charging equipment to claim credits already claimed by another program, or submitting false charging data — will result in immediate account termination and forfeiture of all rewards.

6.0 Carbon Credits and Clean Fuel Regulations

Telemiq operates as an ECCC-registered Charging Network Operator under Canada's Clean Fuel Regulations (CFR). Through this registration, Telemiq aggregates verified home charging data from members, generates compliance-grade carbon credits, and sells them to fuel suppliers who need them for compliance. The revenue from these credit sales funds your rewards.

Individual EV owners cannot generate credits under CFR on their own — the regulatory requirements (ECCC registration, continuous data collection, third-party verification, annual audits) make it impractical. Telemiq bridges this gap through its ECCC registration, creating a circular economy where EV owners benefit from the carbon value they generate.

Rewards are not guaranteed and depend on the successful generation and sale of carbon credits. Market conditions, regulatory changes, and audit outcomes may affect reward amounts and timing. Telemiq makes no guarantee of specific reward amounts or payout schedules.

7.0 User Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in any way that violates applicable laws or regulations.
  • Attempt to gain unauthorized access to any portion of the Service or any systems or networks connected to the Service.
  • Use any robot, spider, scraper, or other automated means to access the Service without our express written permission.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Share your account credentials with any third party or allow anyone other than yourself to use your account.
  • Attempt to manipulate or falsify charging data, geofence location, or any other data used to calculate rewards.

8.0 Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and data compilations, are the exclusive property of Telemiq Solutions Inc. or its licensors and are protected by Canadian and international copyright, trademark, and other intellectual property laws.

9.0 Limitation of Liability

To the maximum extent permitted by applicable law, Telemiq Solutions Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

In no event shall our total liability to you for all claims arising out of or relating to the use of the Service exceed the amount paid by you to Telemiq in the twelve (12) months prior to the event giving rise to the claim.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages. Accordingly, some of the above limitations may not apply to you.

10.0 Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Your continued use of the Service following the posting of any changes to the Terms constitutes acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Service.

11.0 Install Partner Program

The following terms apply to electrical contractors and installers enrolled in the Telemiq Install Partner Program ("Install Partners").

Lead Referral. Clients submit installation requests through the Telemiq platform. Telemiq forwards each request to the selected Install Partner by email as a referral lead. The Install Partner may contact the client by email or phone to discuss the installation. Telemiq does not guarantee the number, quality, or conversion of leads.

Referral Fee. For each completed installation originating from a Telemiq lead, the Install Partner pays Telemiq a flat referral fee of C$50 to C$100 based on the scope of the installation. The fee is payable by Interac e-Transfer to [email protected] upon completion of the installation.

Client Rewards. When an installation is confirmed as completed, Telemiq will credit the referring client's Telemiq account as part of the client rewards program. This credit is issued by Telemiq at its discretion and is not deducted from the Install Partner's compensation for the installation itself.

Client Payment. Payment terms between the Install Partner and the client — including cash, card, or other methods, and whether a receipt is provided — are determined solely by the Install Partner. Telemiq does not process, hold, or guarantee client payments to Install Partners.

Transaction Verification. Telemiq maintains a tracker to verify referred installations and transactions. Install Partners agree to provide accurate installation records and confirmation details when requested, so that Telemiq can validate the completion of the installation and process the client credit.

Code of Conduct. Install Partners must hold a valid ECRA/ESA licence (or provincial equivalent), perform work to code, and comply with all applicable laws and regulations.

Termination. When providing services to clients referred through Telemiq, Telemiq reserves the right to suspend or terminate the Install Partner relationship at any time, in whole or in part, if Telemiq suspects any fraud, breach of contract, misconduct, or violation of applicable laws or regulations. Upon termination, pending leads may be reassigned and the Install Partner may be removed from the directory. Sections that by their nature should survive termination (including fee obligations for completed installations and transaction verification) remain in effect.
